SMS Terms & Conditions

1. Acceptance of SMS Terms

By providing your mobile telephone number to TrustBridge Capital™, LLC ("TrustBridge," "we," "our," or "us") and affirmatively consenting to receive SMS text messages, you agree to these SMS Terms & Conditions ("SMS Terms").

These SMS Terms govern your participation in TrustBridge Capital's SMS messaging program and supplement, but do not replace, our Privacy Policy, Terms of Use, and any other agreement you may have with TrustBridge Capital.

In the event of any conflict between these SMS Terms and a separately executed written agreement between you and TrustBridge Capital, the terms of the separately executed written agreement shall control with respect to the subject matter of that agreement.

Participation in our SMS messaging program is voluntary. Your consent to receive SMS messages is not a condition of obtaining financing, purchasing any product or service, or establishing a business relationship with TrustBridge Capital.

2. Types of SMS Messages

If you have provided the required consent, TrustBridge Capital may send SMS text messages relating to your relationship with us. Depending upon your interactions with TrustBridge Capital, you may receive messages regarding:

• Responses to loan inquiries and financing requests. 
• Loan application status and updates. 
• Requests for documents or additional information. 
• Underwriting conditions and loan processing updates. 
• Appointment confirmations and reminders. 
• Property inspections, appraisal scheduling, and valuation updates. 
• Closing coordination and funding notifications. 
• Customer service and account support. 
• Responses to questions or requests submitted to TrustBridge Capital. 
• Educational information regarding our lending products and services. 
• Marketing or promotional communications, only where you have separately provided any consent required by applicable law. 

The types of messages you receive will depend upon your relationship with TrustBridge Capital and the communication preferences you have selected or authorized.

TrustBridge Capital reserves the right to modify the categories of SMS communications it provides at any time, subject to applicable law and any required consent.

3. Consent to Receive SMS Messages

TrustBridge Capital sends SMS messages only to individuals who have provided the consent required by applicable law.

Consent may be obtained through one or more of the following methods:

• Submitting a loan inquiry, application, or other online form containing an SMS consent disclosure. 
• Providing your mobile telephone number and requesting SMS communications during a telephone call, meeting, or other interaction with TrustBridge Capital. 
• Opting in through an electronic document, customer portal, or other digital platform operated by TrustBridge Capital. 
• Initiating SMS communications with TrustBridge Capital and subsequently providing any consent required by applicable law. 
• Any other lawful method of obtaining consent recognized under applicable law. 

By providing your mobile telephone number and the required consent, you represent that:

• You are the authorized user or subscriber of the mobile telephone number provided. 
• You are authorized to consent to receive SMS messages at that number. 
• The information you provide is accurate and current. 

You agree to promptly notify TrustBridge Capital if your mobile telephone number changes or is transferred to another person.

TrustBridge Capital reserves the right to discontinue SMS communications where consent is withdrawn, where delivery is no longer permitted by applicable law, or where TrustBridge Capital otherwise determines that continued messaging is inappropriate or no longer necessary.

 4. Message Frequency and Charges

Message frequency will vary depending upon your relationship with TrustBridge Capital, the status of your loan inquiry or transaction, your communication preferences, and the products or services you request.

TrustBridge Capital does not charge a separate fee for sending SMS messages. However, message and data rates may apply according to your wireless carrier's messaging plan. You are solely responsible for any fees or charges imposed by your mobile carrier

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and other third-party service providers and is not guaranteed by TrustBridge Capital.

TrustBridge Capital reserves the right to modify the frequency, timing, or content of SMS communications, or to suspend or discontinue its SMS messaging program, at any time and without prior notice, subject to applicable law.

5. Opt-Out and Help

You may opt out of receiving SMS messages from TrustBridge Capital at any time by replying STOP to any SMS message you receive from us.

Upon receiving your STOP request, TrustBridge Capital will make commercially reasonable efforts to process your request promptly. After your opt-out request has been processed, you will no longer receive SMS messages from that messaging program, except where necessary to confirm your opt-out, comply with applicable law, or where otherwise permitted by law.

TrustBridge Capital reserves the right to discontinue SMS communications with any recipient at any time, with or without notice, to the fullest extent permitted by applicable law.

TrustBridge Capital respects your privacy and is committed to protecting the confidentiality of your personal information.

Information collected in connection with our SMS messaging program is subject to our Privacy Policy and will be used solely for legitimate business purposes, including communicating with you regarding your loan inquiry, financing request, application, transaction, customer service, appointments, account activity, and other services you have requested or authorized.

SMS consent, mobile telephone numbers, and related messaging information will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

TrustBridge Capital may disclose SMS-related information to trusted service providers solely to the extent necessary to facilitate the delivery of SMS communications, operate our messaging platform, comply with applicable law, protect our legal rights, or otherwise provide services on our behalf. Such service providers are contractually obligated to maintain the confidentiality and security of the information and may not use it for their own independent marketing purposes.

 7. Disclaimer of Warranties and Limitation of Liability

TrustBridge Capital's SMS messaging program is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, to the fullest extent permitted by applicable law.

TrustBridge Capital does not warrant or guarantee that SMS messages will be delivered, received, transmitted, or accessed without interruption, delay, error, or omission. Delivery of SMS messages is subject to the availability and performance of your wireless carrier, mobile device, third-party service providers, network availability, and other factors beyond the reasonable control of TrustBridge Capital.

To the fullest extent permitted by applicable law, TrustBridge Capital shall not be liable for any loss, damage, expense, claim, or liability arising out of or relating to:

• Delayed, failed, intercepted, duplicated, corrupted, or undelivered SMS messages; 
• Network outages or wireless carrier interruptions; 
• Mobile device malfunctions or software failures; 
• Unauthorized access to your mobile device; 
• Your failure to maintain accurate contact information; 
• Your failure to receive or review SMS communications; or 
• Your use of, or inability to use, the SMS messaging program. 

Nothing contained in these SMS Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.

 8. Changes to These SMS Terms

TrustBridge Capital reserves the right to modify, amend, or update these SMS Terms & Conditions at any time to reflect changes in applicable law, regulatory requirements, carrier rules, messaging platform requirements, business operations, technology, security practices, or our SMS messaging program.

When revisions are made, the Effective Date at the beginning of these SMS Terms will be updated. Unless otherwise required by applicable law, revised SMS Terms shall become effective immediately upon posting to the TrustBridge Capital Website.

Your continued participation in the TrustBridge Capital SMS messaging program following the effective date of any revised SMS Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue participation in the SMS messaging program by replying STOP to any SMS message or by contacting TrustBridge Capital.

TrustBridge Capital reserves the right to modify, suspend, or discontinue all or any portion of its SMS messaging program at any time, with or without notice, to the fullest extent permitted by applicable law.

These SMS Terms & Conditions are incorporated into and should be read together with the TrustBridge Capital Privacy Policy and Terms of Use, which are available on our Website.

 If any provision of these SMS Terms & Conditions is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. TrustBridge Capital's failure to enforce any provision of these SMS Terms shall not constitute a waiver of that provision or any other provision.
